Divorce is a permanent legal separation—of your marriage, your custody rights, your property, and your debts. Idaho is a “no-fault” state, which means you do not need to justify your reasons for divorce. In cases with minor children, the court will assign custody rights to parents based upon Idaho’s “best-interests” factors. Child support is then assigned based upon visitation time and income of the parties.
Most Idaho districts now follow the “Idaho Family Law Rules of Procedure,” which are designed to help streamline divorce and custody cases. Knowing your rights and options within the new rules is key to a successful outcome.
